Exclusivity Contract for the Sale of Real Estate
This contract is entered into on 2025 between:

[Name of the Platform or Agency], with address at [full address], represented by [name of representative], identified by [type and number of document], hereinafter referred to as "THE PLATFORM".
Clauses
FIRST: Object of the contract
THE OWNER grants THE PLATFORM exclusivity for the promotion, management, and marketing of the property located at [address of the property], according to the terms and conditions established in this contract.
SECOND: Duration of the contract
This contract will be valid for [term in months/years], beginning from the date of its signing. Exclusivity may be renewed by mutual written agreement prior to expiry.
THIRD: Obligations of THE PLATFORM
- Publish the property on its digital platform and other marketing tools.
- Provide professional advice and continuous follow-up to potential buyers.
- Manage visits to the property, coordinating them in advance with THE OWNER.
- Inform THE OWNER in a timely manner about the offers and progress of the sale process.
FOURTH: Obligations of THE OWNER
- Not hire other platforms, agents, or entities for the promotion and sale of the property during the term of the contract.
- Provide truthful information and legal documents that support the ownership of the property.
- Allow visits to the property in coordination with THE PLATFORM.
FIFTH: Exclusivity
THE OWNER guarantees THE PLATFORM exclusivity for the sale of the property during the term of the contract. In the event that THE OWNER fails to comply with this clause, they will be obliged to compensate THE PLATFORM with a penalty equivalent to [percentage] of the sale price of the property or [specify fixed amount].
SIXTH: Fees
In the event of the sale of the property, THE OWNER will pay THE PLATFORM a fee equivalent to [agreed percentage] of the final sale price. This payment will be made at the time of closing of the transaction.
SEVENTH: Termination of the contract
The contract may be terminated in advance by:
- Mutual agreement between the parties.
- Failure to comply with any of the stipulated obligations.

Both parties agree to keep confidential any personal, legal, or commercial information related to the property during the term of the contract and after its termination.
